1. About FLVUNT

FLVUNT Pty Ltd operates the FLVUNT online store and related digital platforms. FLVUNT currently sells and delivers products within South Africa. The website is primarily an online retail platform and may include product information, editorial content, photography, campaigns, customer reviews and other brand-related material.

2. Using the website

You agree to use the FLVUNT website lawfully and responsibly. You must not:

• use the website for fraudulent or unlawful purposes;
• attempt to gain unauthorised access to the website or its systems;
• interfere with the operation or security of the website;
• introduce malicious code, software or other harmful material;
• scrape, reproduce or systematically extract website content without permission;
• use FLVUNT's systems to distribute spam or malicious communications; or
• misrepresent your identity or relationship with FLVUNT.

FLVUNT may restrict or suspend access to the website where reasonably necessary to protect the website, FLVUNT, its customers or other users.

3. Product information

FLVUNT makes reasonable efforts to ensure product descriptions, photographs, measurements, colours and other information are accurate. Differences may occur between photographs and the physical product due to screen and device settings, lighting and photography conditions, manufacturing processes, fabric characteristics, and reasonable variations between individual products. Review product measurements and sizing before ordering. Where FLVUNT becomes aware of a material error in product information or pricing, it may take reasonable steps to correct it. Nothing in this section limits a consumer's rights where goods do not correspond with their description or otherwise fail to meet legal requirements.

4. Product availability

Products displayed on the website are subject to availability. FLVUNT may offer certain products on an availability-based or production-after-order basis. Some products, including Essentiel 26 tracksuit sets, may be available to order even when the physical product is not immediately ready for dispatch. Where additional production is required, the expected timeframe will be communicated to the customer — approximately 14 days to one month, depending on the product and production circumstances. An estimated production timeframe is not a guaranteed delivery date.

5. Pricing

Prices are stated in South African Rand (ZAR) unless otherwise indicated. FLVUNT may change prices at any time before an order is completed. The price applicable to a completed transaction is the price presented at the time the order is placed, subject to correction of genuine pricing errors and applicable law. Delivery charges are displayed separately at checkout. FLVUNT may offer promotional pricing, discounts or limited-time offers subject to the terms communicated with the relevant promotion.

6. Orders

Submitting an order constitutes an offer by the customer to purchase the selected products. An order is not necessarily accepted merely because it was submitted or an automated acknowledgement was received. FLVUNT may need to verify payment, product availability, delivery information or other details before confirming an order. Once accepted, the customer will receive an order confirmation.

7. Order cancellation

FLVUNT may cancel an order where reasonably necessary, including where:

• a product is unavailable and cannot reasonably be fulfilled;
• a genuine pricing or product-information error has occurred;
• payment has not been successfully completed;
• delivery information is materially incomplete or invalid;
• fraudulent or unauthorised activity is reasonably suspected; or
• another circumstance requires cancellation under applicable law.

Where FLVUNT cancels an accepted order and payment has already been received, FLVUNT will provide the applicable refund or other remedy. Nothing here limits any cancellation rights provided to consumers by applicable South African law.

8. Payment

Payments are processed through the methods available at checkout and are subject to successful payment authorisation. FLVUNT does not treat an unsuccessful, reversed or declined payment as a completed purchase. Customers must provide accurate information required to complete payment and fulfil the order. Where a payment is reversed, disputed or identified as unauthorised, FLVUNT may investigate and take reasonable steps to protect against fraud or financial loss.

9. Delivery

FLVUNT currently delivers within South Africa. Standard delivery is generally processed within 1–2 business days, followed by an estimated courier delivery period of approximately 1–5 business days after dispatch. Delivery timeframes are estimates and may vary depending on destination, courier operations and other circumstances outside FLVUNT's reasonable control. Orders dispatched through The Courier Guy will generally receive a tracking number. Full arrangements are set out in the FLVUNT Shipping Policy.

10. Local collection

FLVUNT offers local collection from its headquarters at Equestria Estate, 2115 Cura Avenue, Pretoria, South Africa. Collection is available by prior arrangement and appointment only. The collection location is FLVUNT's headquarters and is not a conventional retail store or walk-in shop — contact FLVUNT and arrange a collection time before arriving.

11. Returns and refunds

Returns and refunds are governed by the FLVUNT Returns Policy and Refund Policy, which form part of these Terms. Nothing in FLVUNT's returns or refund procedures limits any mandatory consumer rights available under South African law.

12. Sale and made-to-order products

Unless otherwise stated, sale, promotional and made-to-order products are not eligible for change-of-mind returns or refunds. This does not exclude statutory rights relating to defective, unsafe, incorrect or non-conforming products. Where applicable law provides a consumer with a remedy, FLVUNT will comply with that requirement.

13. Intellectual property

Unless otherwise indicated, the FLVUNT website and its contents are owned by or licensed to FLVUNT, including trademarks, logos, wordmarks, product names, graphics, product designs, photography, campaign imagery, videos, website layouts, written content, illustrations, digital assets and other original creative material. You may not reproduce, modify, distribute, commercially exploit or use FLVUNT's intellectual property without prior written permission, except where permitted by law. Purchasing a FLVUNT product does not transfer ownership of FLVUNT's intellectual property.

14. FLVUNT brand material

The FLVUNT name, logos, marks, designs and visual identity may not be used in a manner that falsely suggests sponsorship, affiliation, endorsement or partnership with another person or organisation. Unauthorised reproduction of FLVUNT branding or designs for commercial purposes is prohibited.

15. User-submitted content

Where customers voluntarily submit reviews, photographs, testimonials or other content, they remain responsible for ensuring they have the necessary rights to submit it. By submitting content for publication or promotional use, the customer grants FLVUNT permission to use it for the purpose it was submitted for, subject to applicable law. FLVUNT may remove user-submitted content where reasonably necessary, including where it is unlawful, misleading, abusive, defamatory, infringing or otherwise inappropriate.

16. Reviews

Customer reviews represent the opinions and experiences of the customers who submit them. FLVUNT may moderate or remove reviews that contain unlawful, abusive, fraudulent, misleading or irrelevant content, and will not knowingly create false customer reviews or represent a fabricated experience as genuine.

17. Third-party services

The FLVUNT website may rely on third-party services for payment processing, hosting, delivery, analytics, communications and other technical functions. Third-party services may have their own terms and privacy policies. FLVUNT is not responsible for the independent operation, availability or policies of third-party services, except where applicable law provides otherwise.

18. Website availability

FLVUNT aims to keep the website available and functioning correctly but does not guarantee uninterrupted or error-free access — the website may occasionally be unavailable due to maintenance, updates, technical failures, hosting or infrastructure issues, security incidents, third-party service interruptions, or other circumstances beyond FLVUNT's reasonable control. FLVUNT may modify, suspend or discontinue portions of the website where reasonably necessary.

19. Cybersecurity and misuse

You must not attempt to compromise the security of the FLVUNT website or its underlying infrastructure — including attempting to access restricted systems, obtain another person's account or transaction information, circumvent authentication or security controls, introduce malicious software, conduct denial-of-service attacks, probe or scan systems without authorisation, or exploit technical vulnerabilities for unauthorised purposes. FLVUNT may take appropriate action where unlawful or malicious activity is detected.

20. Limitation of liability

To the extent permitted by applicable law, FLVUNT will not be responsible for indirect, incidental or consequential loss arising from the use of the website or a delay or interruption caused by circumstances outside FLVUNT's reasonable control. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, or limits a consumer's statutory rights or remedies.

21. Events outside FLVUNT's reasonable control

FLVUNT will not be considered in breach of these Terms where performance is prevented or materially delayed by circumstances beyond its reasonable control, including natural disasters, severe weather, power or infrastructure failures, internet or telecommunications failures, courier disruptions, strikes or industrial action, government action, civil unrest, widespread technical failures, cybersecurity incidents, or other circumstances that could not reasonably have been prevented or controlled by FLVUNT. FLVUNT will take reasonable steps to resume affected services or fulfil affected orders when reasonably possible.

22. Privacy

FLVUNT's collection and processing of personal information is governed by the FLVUNT Privacy Policy. By using the website, customers acknowledge that personal information may be processed for purposes necessary to operate the website, fulfil orders, process payments, provide support and otherwise conduct FLVUNT's business in accordance with applicable law.

23. Electronic communications

By placing an order or communicating with FLVUNT electronically, you acknowledge that FLVUNT may communicate with you electronically regarding your transaction, including order confirmations, payment confirmations, delivery updates, tracking information, collection arrangements, return communications, refund communications, and other communications necessary to administer your order. Marketing communications are subject to the FLVUNT Privacy Policy and applicable law.

24. Notices and website information

FLVUNT may update product information, website content, policies and other information from time to time. The latest version of applicable policies will be published on the website — review the relevant policies before placing an order.

25. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with in accordance with applicable South African law and the jurisdiction of the appropriate South African courts or other legally available dispute-resolution mechanism. Nothing in this section prevents a consumer from exercising a statutory right to approach a competent consumer authority, tribunal, ombud, court or other body where such right is available.

26. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or removed to the extent necessary, without affecting the validity of the remaining provisions.

27. No waiver

If FLVUNT does not immediately enforce a provision of these Terms, this does not mean FLVUNT has waived its right to enforce that provision later.

28. Entire agreement

These Terms, together with the FLVUNT Privacy Policy, Shipping Policy, Returns Policy and Refund Policy, form the principal terms governing use of the FLVUNT website and purchases made through it, subject to applicable law.
